Abstract

The article analyzes "El indulto", a story by Emilia Pardo Bazán written in the
stage of dissemination and discussion of naturalism, as a story that presents the female main
character’s situation of abandonment as a consequence of the general pardons. This issue had
been revealed as problematic for the institutions and society, echoed by the press. The paper
contextualizes this specific legal problem on general pardons. It also shows examples of the
concern that jurists such as Pedro Armengol y Cornet and Concepción Arenal showed about the
munificence and arbitrariness with which this right of mercy was applied. In addition, it provides
other testimonies of Pardo Bazán about pardons after the publication of this short story. Finally, it
shows how the structure of the story confronts the immutability of the law with the arbitrariness
of general pardons with the purpose of separating the judicial sphere from the political one, even
